Isn't it AWESOME! You see there's quite a story attached to this piece now. Apparently it was given to me by mistake. I had thought it was a gift, but was told there was a misunderstanding. So I offered to send the item back to the original owner and he said not to worry about it. Just keep it. I offered a couple different times. The owner, Jason, was an absolute dear and said no worries. So hurray for me right? WRONG!

Some ass hat of a collector decided that this wasn't ok since he wanted the settei. So he decides to contact anyone and everyone he can to complain about how I'm abusing my mod/admin status and robbing someone of their artwork. Seriously? Are you freakin kidding me? The original owner in the meantime is sitting back and watching this with a good laugh. As he should. It's ridiculous. I felt so bad for poor Jason to have to deal with this crap. This didn't even concern the other ass wipe. Needless to say I went ahead and offered to pay for the item and now it's in my gallery outright.

But let this be a lesson to people. If anyone sends you something and calls it a gift. Whether it was called a gift initially or after the fact....make sure you pay for the gift anyway. Also be aware that if you don't pay for these gifts that you'll be blacklisted by other collectors who had nothing to do with the situation.

Please note that this piece will never leave the USA! It will never be seen in France. NEVER!

I had initially removed my blacklist of people I hate because I hadn't needed it in awhile. Looks like I need to restart it. I'll need to find the other problem children from before, but in the meantime I've added the biggest one of them all on the front page.

If anyone reads beta they know that this is the LAST thing I need to deal with right now. I can remember Wendy blogging about an issue with a french collector awhile ago. There was a discussion why there were so many issues with them. At least I think it was on her blog....my memory is terrible these days with the stress. I've had plenty of issues before, but then they stopped and I began trusting them again. Well that is now shot to hell. No more dealings with France. I'm not racist, but I also don't feel like putting up with drama where there should be none.

To summarize.....always pay for items given to you. Never accept gifts.

To those innocent people out there reading this rant I apologize. I needed to vent somewhere and just get stuff off of my chest...."again no pun intended". ^_~

Now to get back to my doctor's appointments for biopsies. Yeehaw!

Wow. Even if the other collector had offered $$$ for that settei, it was given to you as a gift. There is NOTHING they can say about it. The dissemination of that artwork was at the discretion of the original owner. Just because someone offers to buy something doesn''t mean the owner MUST sell it! *shakes head* It takes all kinds...

Sounds pretty bad GK. =( A few rotten apples.... Our sympathies! Was the person defaming you someone remotely reputable? If not we wonder if a good alternative to paying, might have been to reply to the issue in some of visible forums?

Not that it''s too surprising. The collector in question really confuses me. A lot.

This kinda reminds me of the some of the berating emails I received from a certain Ai Yori Aoshi collector after constantly outbidded him on YJ for pieces Maria liked. Like he was owed them cause he really wanted them so I should sell them to him right now....

Thanks y''all. To answer your question Momo the person in question is on my front page of this site at the bottom under news. They are also on beta trying to buy up artwork for cheap and of course selling it on some 2010 museum bullshit. Just beware people. And thanks to everyone for the sweet posts and kind PMs on beta.

...now go collect that money for those gifts! LOL!

Oh man Angela, that sucks. You know, I''m sorry you let yourself be intimidated by this jerk.
I''ve been perking some brows when I read some of his posts at Beta, especially the ones in the struggling celdealers thread >_<

I''ve had encounters with French collectors, both buyers and sellers. Most of them have been great, but there have been incidents as well where I thought I''d never wanted to deal with again.

But that goes for some US collectors as well. It seems people find the recession a good excuse to be extremely rude or offensive.

But hey, it''s good te read you havent lost your sense of humour ;)

You forgot half of the story, which looks now partial and generates the agreement of RS members, this is mainly called revisionism.

Concerning gifts, from nov 2007 till dec 2009 I''ll have offered a total of 118 gifts all over the world for a total of $1300, so please don''t start again this sarcastic one way story or refer to a country with clichés.
This is also interesting and funny that you forgot our open $400 deal that I prefer cancel due to this $100 affair.

Yes let''s tell them about the cel I was selling for $600 and graciously accepted your $400 offer on that you then backed out of since this whole innocent issue between Jason and I has offended you. How dare I abuse my admin power by accepting gifts. ROFLMFAO! As for Anime Beta they other mods and admin aren''t my parents. You seem to forget that this issue is separate of Anime Beta or Rubberslug. Sales/Gifts are not the responsibilities of these websites. I warned you I would tell the whole cel community what fraud you truly are. Now they know. All is right with the world. Good luck getting any business.

I''m really glad I read this entry. I saw iceman''s posts on Beta and was about to offer to look for some cels for his project while at Mandarake. But having read this, I''d rather buy them for myself and exhibit them on my RS gallery instead.

And I agree with everyone else - a gift is given for free. It is not something you pay to own.

Now read all politely...

Imagine that you mistakely have a missing cel in an expedition, you''ll claim the seller.
Reverse the situation, if you get an extra item, how will you inform the seller about ?...

"I''ve an extra genga" -> "keep it"
"I''ve an extra genga handwritten by Tezuka, here is the picture" -> "Ouch thank you to return, we handle the costs".
(receiving a 2 carats diamond from Tiffany by "mistake", and simply saying, "I''ve an extra ring".)

Fact is that on an open sale thread was appearing this settei picture (had been removed, don''t wanna debate who has enough power/access on a board to censor/hidden it).
Legally speaking, there''s an open sale on this item, an option is put on this item and while dealing the item appear to have been wrongly sent to another person.
This is not called a "gift", this is called information keeping and not acceptable as the concerned member informed the seller of this mistake during the sale, especially by an important board staff member.

This is not a matter of win or lose an item, I can wait for another item as I''ve almost a year to collect arts.
Problem is when someone has responsability in the anime cel universe, this person has to act even more correctly than any regular member, that was the reason of my administrator claim.

Open eyes, this is totally unfair regarding the seller.
After this claim he had been paid according to the value of the sale from this "mistaken" item.
At my side deal is over and the settei is property of the new owner and stays in the USA.
This is a really nice item that will perfectly fit a private collection.

I''ve communicate each time the most politely as I can, and administators have asked for mutual respect on both side.
One side didn''t respect the engagement and opened this RS blog entry, so I reported again to administrative staff as for me this case was close since yesterday and forced to reopen today.

All the sarcasm about a country (that composed the color of US Flag, or sent Lafayette, don''t forget about history) or a private non commercial project are totally non constructive and pure clichee.
I handle the whole responsibility to have open a claim about the settei that was supposed to be closed, time for the other party to calm down and return to reason.
Threats, flaming, lobbying and any other mark of non respect of the administrators agreement would forced me to each time generate a new claim.
I''m not willing to gain or lost appreciation for members, simply asking for the respect of the agreement.

I''m already bidding on an handwritten letter signed by "Cecile Aubry" (you can check wikipedia about her and the series), so be kind to no more continue to post here totally partial opinions about this settei sheet.

First of all, the author of any part of any thread can edit their own wording - whether they are a mod or not. For you to think that Ang hacked into the thread and altered it is not only paranoid, it''s offensive. And I really don''t know what else Ang could have done. Both her and Jason knew what was going on the entire time - and they remedied their private situation. For you to make this a personal attack against you and twist it in such a crazy manner is a little unnerving.

Mistakes happen. Jason accidentally posted something for sale. Hell, I just recently started an Ebay auction for an incorrect item - one that I had just sold. I remedied the situation when someone else pointed it out.

And as far as nationality goes, I don''t care where the hell you are from. You could be my next door neighbor. If you''re acting like an ass, I''m going to tell you.

Oh, and another thing - Angela is not paid anything to be an admin on Beta. Hell, most of the time its a thankless job. This is just another example of that. We may be mod or admin, however, we are collectors first. If someone makes a mistake and sends us something extra, and we inform them and offer to return, yet they say to go ahead and keep it, we are no more obligated to send it back then the next person. Angela offered to send this back, Jason told her to keep it, as it was his error. But then after you just pushing and pushing, Angela went ahead and paid him anyway. Not that it was any of ytour business in the first place.

And, I have to agree with Jenn. YOu even himting that Angela removed that image is offensive. I''m sorry, but we don''t take advantage that way. We have many friends in this community, and they know that we are good, honest people. I would say you owe Angela a public apolgy for that statement.

And yep, doesn''t matter where you are from. An Asshat is an Asshat not matter what part of the world they are from.

This affair had been exposed by both parties and aknowledge by a third party as settled on a major collector board.
Following this claim request, several changes and comments appeared on the open sale thread within 24h.
Open sale returned to legality as the concerned item announced in the sale had been paid to the seller its requested amount value.
Case was then considered as closed and the artwork property transferer to its new owner.

Afterwhat, this affair supposed to be closed and kept in privacy, falled in public area on this RS weblog.
This was not suppose to happen and to follow this way of a partial public debate capitalizing on a community friendship network lobbying.
Discussion about this private affair infreign the previous settled agreement that was considering the case as closed.
I won''t have to be forced to restart a claim procedure...

Consequently, be kind to not reopen this case with comments as this is considered as closed at my side since yesterday at the payment time.

Whatever I''m not mother english speaker, I believe have beeing polite, readable and calm enough during all my communications.
This is the best way to follow, and I hope that you''ll all be reasonable.

With the hope you may finally remain this case closed.

It was afterwards that he decided I had broken some rule. LOL! Really? LOL! Sigh.... Don''t worry Iceman. Offered the price of the announced open sale from $50 to $100 range and the fact that this was a mistaken item in your destination.

At this time there were two ways to solve the case : returning it to its seller to let me complete with him open sale transaction, or receive my cash and arrange yourself with the seller for payback.

As this open sale item was deliberately missing while being on hold at my side and because you stayed on your position, I was forced to open a regular claim.
If you were a singular member I never had to, I''d have let it go.
As you were part of the staff you were supposed to be more representative than any member and I consequently asked upper level hierarchy for mediation assistance.

Mediation solution was that you paid the item, transfering the seller property to your own, and consequently becoming the new owner.
You paid the deal price, item is yours, case closed at my side.

You''ve the ability of turning words at your advantage by using a lobbying position.
Be gentle to remove all sarcastic terms, calm down, and to finally follow the settled three party agreement about this closed case.

As Alec has repeatedly told you, we, as mods, have absolutely NOTHING TO DO with sales - those on Beta or off. We state that in the rules on the board. You did not open any "claim" with anyone associated with beta, as we DO NOT handle any such situation.

"Any transactions/sales/purchases/trades/etc entered into between Beta members should be considered "At your own risk". Anime-Beta is a private non-commercial message board, not an e-store or auction site. We can not offer any guarantees about any aspect of a private transaction between forum members.

The Admins/Mods cannot and will not get involved in disputes between members. We have no more authority or power in enforcing a transaction than any other member of the site. We can do little more than tell when a member last logged into the Forum, and what contact information is entered in a user''s profile.

We are willing to do the following to aid members:
* A post can be made by a member asking the forum for help contacting or locating another member. This Post will be made a sticky and left prominent for 10 days.

* Should the situation not be resolved, a post can be made in "Buyer Beware" to alert the forum about a seller. These posts will follow the requirements and rules posted in "Buyer Beware" and will only be open to the members involved in the specific transaction. These posts will not be open to general posting to avoid a flame war.

You may still feel free to ask advice of the Admins/Mods should you end up in a situation with an incomplete transaction, but we will not get directly involved in the dispute. "

You obviously are not getting the entire point of this thread. A "gift" is a "gift". Money is never involved with a gift.

That was exactly the followed procedure and the exact terms I copied/paste to administrative staff. Additionnal sent note was that I had no intention to damage/infreign and only a request of administrative advice about this deal.

That switched to a be regular claim, like in any business deal in any company. As this business transaction wasn''t valid as it due to on hold situation. This claim procedure clarified the transaction, item goes to a new owner after being paid to transfer its property.

Accordingly to the previous agreement this settled transaction normally have to remain in private domain by the two parties and not on a blog to communicate and will to lobby publically a board member.

This lobbying operation didn''t respect the settled agreement that was considering the case close the minute the new owner paid at least one dollar for the item.

Be kind to respect this agreement and to consider this affair as remaining a private case, and not to act publically on it.

It appears that your vision of a private business transaction between seller and buyers unfortunaly appears to be truncated.
There were four persons implicated in the PM exchanges (PM stands for Private Message), and consequently this had to remain in this way.

By beeing administrative on AB board where members crosses with the RS ones, you use this power to manipulate crowd at your advantage.
This is totally unfair, and commonly called lobbying, barely acceptable for an administrator.

You persist in your obstination, while at my side case was supposed to be closed since yesterday but you persists in your anger to maintain it constantly reopened.
This has no places here and infreign the common RS blogging rules (flaming, trolling, threats)...
Consequently you forced the blog entry to be reported to RS staff.

Calm down, return to reason, and keep this affair remaining closed between the four concerned actors.
As wrote up, at my side case is close, be kind to not repoen it.

After reading the back & forth this is the facts I can be sure of.
1. Jason had a piece of artwork Iceman was interested in.
2. Jason sent said artwork to Goldknight
3. Goldknight finding artwork she did not order contacted Jason and was told not to bother returning it and accept it as a gift.
I see any problem should have been between Iceman & Jason not Goldknight. The artwork was Jason''s to do with as he wants. I have not seen any statements from Iceman that he sent any money to Jason for thr artwork before it was shipped to Goldknight so as it was still Jason''s property it was his to do with as he chooses. In this case he chose to give it to Goldknight.
End of Transaction.
Just cause someone wants a piece does not entitle one to have it. Goldknight is under no responcibility to sell it to anyone for once Jason told her to keep it as a gift it is now her property to keep, sell , give away or use to start her fireplace.
As far as France, there are a lot of good collectors located in that country but also over the years there has been quite alot of bad people there that ripped off a lot of collectors on Ebay as well as private buyers. For a long time it seemed that the bad transactions greatly outnumbered the good ones though I suspect that it was truly only a couple of ripoff artists who constantly changed their names to continue their scams. It is quite unfair to paint a county''s cel community badly due to actions of some of it''s memembers it is prudent to take each person on their own merits and judge them by their interactions.

One last thing though Iceman57, I''ve read 5 times now that you consider this case closed, but still you keep coming back to reopen it and get pawned by the ladies.

The cel community is a small one and the pompous way you are handling this isn’t going to make you many friends. Nor is your persistence to continue to speak in that condescending and patronizing way going to win you this case. The people in this community are long time collectors, not a bunch of little school children you can lecture.

We’ve all had our share of sour grapes at one point or the other, that’s the nature of this game. So please, get over yourself, take your loss and deal with it.
